Marshall Security would like to commend Durban North SAPS on the conviction and sentencing of motor vehicle thieves Siboniso Luthuli, Lugano Mthiyane and Nhlakanipho Majola, long time syndicate criminals with previous convictions.
The thieving suspects were caught red handed attempting to steal a VW Polo from the parking lot at Hyper By The Sea in the Durban North area. Observant police officials, Sgt LV Nkosi and Sgt KE Nkwanyana, were on routine patrol in the area when they noticed suspicious activity in the Polo. There was also a getaway vehicle, a Toyota Corolla, parked right next to the Polo. The officers immediately intervened and the suspects were caught in the act.
All three suspects were arrested and prosecuted for the attempted theft of a motor vehicle, and possession of car break-in implements.
The prosecutor, Mr Z Nzuza, focused his case on the evidence and repeat history of the criminals. The accused offered to pay fines into CARA (the State’s criminal asset recovery account); however, Mr Nzuza held his ground and rejected their plea due to the seriousness and repeat history.
The following sentences were handed down at the Durban Magistrate’s Court:
- Accused 1 – 5 years direct imprisonment for attempted theft and 10 months for possession of break-in implements.
- Accused 2 – 10 years direct imprisonment for attempted theft and 12 months for possession of break-in implements.
- Accused 3 – 5 years direct imprisonment for attempted theft and 18 months for possession of break-in implements.
Special acknowledgement was made for Sgt LV Nkosi for excellent crime scene management, detailed and effectively compiled statement, and greatly enhanced the evidentiary value of the evidence. As well as Sgt Shezi of Durban North, who did an excellent job in the investigation and profiling of the repeat offenders.
